1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the Build.MD website at build.md and any related online services we provide (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms apply to the Build.MD website only. Customer relationships are governed by separate written agreements (such as a Master Services Agreement and Business Associate Agreement) entered into directly with Build.MD.
2. Who we are
Build.MD is a technology and management services organization providing infrastructure to operators in cash-pay medicine. Clinical services described on this Site are provided by Access Plus Medical, P.C. ("APM"), a physician-owned corporation, or by other licensed providers under appropriate clinical structures. Build.MD does not directly provide medical care.
3. Informational purpose
The content on this Site is for general informational and marketing purposes. Nothing on the Site constitutes medical advice, legal advice, regulatory advice, or financial advice. Revenue figures and calculators on the Site are illustrative estimates, not promises of results. Operators evaluating Build.MD should consult their own qualified counsel for advice specific to their situation.
Statements about the cash-pay medicine market and regulatory environment reflect our understanding as of the date of publication. Markets and regulations change, and we make no representations about the continued accuracy of historical content.
4. No medical care
Visiting this Site does not create a doctor-patient relationship with Build.MD, APM, or any provider. Information on the Site about specific programs, therapies, or clinical protocols is for general informational purposes. Patients receiving care through Build.MD-supported platforms enter into care relationships with licensed providers through formal intake and consent processes; those relationships are not governed by these Terms.
5. Use restrictions
You agree not to:
- Use the Site in violation of applicable law or regulation
- Attempt to gain unauthorized access to our systems, accounts, or other users' information
- Interfere with or disrupt the operation of the Site
- Use automated tools to scrape, collect, or extract data from the Site without our prior written consent, other than search engines and similar services acting in accordance with our robots.txt file
- Misrepresent your affiliation with Build.MD or any other person or entity
- Use the Site to send unsolicited commercial communications
6. Intellectual property
All content on the Site — including text, graphics, logos, design, software, and other materials — is the property of Build.MD or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use of publicly available content with appropriate attribution.
"Build.MD," the Build.MD logo, and related marks are trademarks of Build.MD. Other names and marks referenced on the Site may be the trademarks of their respective owners.
7. Third-party content and links
The Site may contain links to third-party websites or references to third-party products, services, or companies. We do not endorse and are not responsible for third-party content. Your interactions with third parties are at your own risk and subject to their terms.
8. Disclaimers
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILD.MD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS IS LIMITED TO ONE HUNDRED DOLLARS (USD $100). THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY.
Customer agreements may include separate liability provisions specific to the commercial relationship; those provisions govern the relationship between Build.MD and customers and supersede these general Site terms for that purpose.
10. Indemnification
You agree to indemnify and hold harmless Build.MD and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site or breach of these Terms.
11. Governing law and dispute resolution
The governing law and venue for disputes are being finalized with counsel and will be stated here in the final version of these Terms.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
14. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Build.MD regarding your use of the Site, superseding any prior agreements on the same subject.
